Refund Policy

1. Overview
This Refund Policy applies to all products and services offered by Atominic Technologies ("Atominic," "we," "us," or "our"), including but not limited to Jason (jason.atominic.com), NexChamps (nexchamps.com), and all AI enablement consulting services.
All purchases made through Atominic Technologies are final. We do not offer refunds, returns, or credits of any kind. By subscribing to any paid plan, purchasing any service, or making any payment to Atominic Technologies, you expressly acknowledge and agree to this no-refund policy.
2. No Refund Policy
Atominic Technologies does not offer refunds for any subscription plans, one-time payments, or services rendered, under any circumstances. This policy is strictly enforced and applies without exception.
Without limitation, refunds will not be provided for any of the following reasons:
- Partial use of a subscription period or failure to fully utilize the features included in your plan
- Dissatisfaction with platform features, functionality, user interface, or AI-generated content quality
- Failure to use the platform during any portion of the subscription period, whether due to forgetfulness, lack of time, or any other reason
- Accidental or unauthorized purchases -- you are solely responsible for maintaining the security of your account credentials and authorizing all transactions made through your account
- Downgrading from a paid plan to a lower-tier plan or to the free plan
- Changes in your business needs, circumstances, strategy, or operational requirements
- Technical issues, bugs, or service interruptions that are subsequently identified and resolved by our team
- Duplicate payments -- in the event of a verified duplicate charge, the duplicate amount will be applied as a credit toward your future billing cycle and will not be refunded as cash or returned to the original payment method
- Incompatibility with your existing tools, workflows, or third-party software integrations
- Disagreement with changes to features, pricing, terms of service, or platform policies
3. Free Plan Availability
Atominic Technologies offers a comprehensive free plan across its products, specifically designed to allow prospective users to evaluate the platform's features, functionality, and suitability for their needs before committing to a paid subscription.
We strongly encourage all users to take full advantage of the free plan before upgrading to any paid tier. The free plan provides sufficient access to core features, allowing you to make an informed decision. By choosing to upgrade to a paid plan, you confirm that you have evaluated the platform and are satisfied with its capabilities.
The availability of a free plan is a key reason our no-refund policy is firmly in place. Users have every opportunity to assess the product at no cost before making a financial commitment.
4. Subscription Cancellation
Users may cancel their paid subscription at any time through their account settings or by contacting our support team. Upon cancellation, the following terms apply:
- Continued access: You will retain full access to all paid features until the end of your current billing period. Your subscription will not be terminated immediately upon cancellation.
- No prorated refunds: No refunds, prorated or otherwise, will be issued for any unused portion of the billing period remaining after cancellation.
- Automatic downgrade: At the end of the billing period, your account will automatically be downgraded to the free plan. You will continue to have access to free-tier features.
- Data retention: Your data will be retained for thirty (30) days following the downgrade. After this retention period, data associated with paid-tier features may be permanently deleted and will not be recoverable.
Cancellation does not entitle you to any refund, credit, or compensation of any kind.
5. Plan Changes
Users may upgrade or downgrade their subscription plan at any time, subject to the following terms:
- Upgrades: Plan upgrades take effect immediately. You will be charged the difference or the full price of the new plan as applicable. Access to the higher-tier features will be granted upon successful payment.
- Downgrades: Plan downgrades take effect at the end of the current billing period. You will continue to have access to your current plan's features until that period concludes.
- No refunds or credits: No refunds, credits, or monetary adjustments of any kind will be issued as a result of upgrading or downgrading your plan.
6. Service Credits (Not Refunds)
In exceptional circumstances and at the sole and absolute discretion of Atominic Technologies, service credits may be issued. Service credits are not refunds and are subject to the following conditions:
- Extended platform outages: Service credits may be considered if the platform experiences continuous, uninterrupted downtime exceeding twenty-four (24) hours that is directly attributable to Atominic's infrastructure and not caused by third-party services, scheduled maintenance, or force majeure events.
- Billing errors: If a billing error is confirmed to have originated on Atominic's side (such as being charged an incorrect amount), a service credit for the difference may be applied.
- Credit terms: Service credits are applied exclusively to future invoices. They carry no cash value, are non-transferable, cannot be redeemed for cash, and cannot be applied to third-party services. Service credits expire twelve (12) months from the date of issuance if unused.
The decision to issue a service credit rests entirely with Atominic Technologies. Users are not entitled to service credits as a matter of right, and the issuance of a credit in one instance does not create a precedent or obligation to do so in the future.
7. Chargebacks and Payment Disputes
If you have a concern about a charge, you must contact us directly at contact@atominic.com before initiating any chargeback, dispute, or reversal with your bank, credit card company, or payment provider.
Filing a chargeback or payment dispute without first contacting Atominic Technologies and making a good-faith effort to resolve the issue constitutes a breach of these terms. In the event of such a breach, Atominic Technologies reserves the right to:
- Immediately suspend or permanently terminate your account and all associated services without notice
- Pursue recovery of the disputed amount along with any administrative fees, chargeback fees, and costs incurred
- Report the incident to fraud prevention databases and relevant authorities
- Decline to provide services to you in the future
We are committed to resolving billing concerns promptly and in good faith when contacted directly.
8. AI Enablement Services
Custom AI enablement consulting and implementation services provided by Atominic Technologies are non-refundable once work has commenced. The scope of work, deliverables, timelines, and fees for all consulting engagements are agreed upon in writing before the engagement begins.
By approving the project scope and authorizing work to begin, you acknowledge that:
- All fees paid for consulting services are non-refundable, regardless of the outcome or your satisfaction with the deliverables
- Partial completion of a project does not entitle you to a partial or full refund
- Delays caused by the client (including failure to provide required information, access, or feedback in a timely manner) do not constitute grounds for a refund
- Any modifications to the project scope may result in additional charges, which are also non-refundable
9. Governing Law
This Refund Policy is governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or in connection with this Refund Policy, including questions regarding its existence, validity, interpretation, or termination, shall be subject to the exclusive jurisdiction of the courts located in Gurgaon, Haryana, India.
By using our services and making any payment to Atominic Technologies, you irrevocably consent to the jurisdiction and venue of these courts and waive any objection to such jurisdiction on grounds of inconvenient forum or otherwise.
10. Changes to This Policy
Atominic Technologies reserves the right to modify, amend, or replace this Refund Policy at any time and at its sole discretion. Changes take effect immediately upon posting to our website. The "Effective Date" at the top of this page will be updated to reflect the date of the most recent revision.
Your continued use of any Atominic Technologies product or service after changes to this policy have been posted constitutes your acceptance of the revised terms. It is your responsibility to review this policy periodically.
